On the evening of Wednesday 13th April 1859, Joseph Deacon, a corporal in the Royal Marines, entered the house and offered James Lock a shilling to enlist, which was accepted. Later discovering that Lock was physically incapacitated for the duties of a soldier and had already enlisted on several previous occasions and had always been rejected, Deacon sought to recover the shilling, since he claimed it had been obtained under false pretenses.
On Friday 15th April, the magistrates dismissed the case since Lock had been enlisted when intoxicated.
