In court on Friday 27th July 1849 a claim for damages
for Non-repair was heard. The action was to recover damages for
dilapidation to the Swan public house. The plaintiff was Neale and the
defendants were brewers from the neighbourhood of Wisbech, named
Ratcliffe and Another. The defendants had hired the house from Neale
under an agreement dated 10th May 1845 at a rent of £41, payable half
yearly, with six months notice to put an end to the tenancy by either
party. Upon giving up the premises the defendants were to leave the
house in good and tenantable repair. They left at Michaelmas 1847.
The Plaintiff claimed that before the defendants had taken possession the property had been put into proper repair, but it was argued that
upwards of £200 would have been required to put in substantial
repair and to achieve a tenantable
state, £60 would be required. As it was tradesmen's bills fell very
short of that sum.
After a hearing taking five hours, the Jury found substantially for the
Plaintiff with damages of £20, but other issues were found for the
defendants.
